Legal Action Targets Prediction Markets
Flight tracking service FlightAware has filed a lawsuit against Kalshi, a platform for prediction markets. The action, lodged in a New York district court, claims Kalshi misused FlightAware’s data and trademarks. This alleged misuse facilitated betting markets on flight cancellations. Kalshi, established in 2018, permits consumers to wager on various future events.
On July 14, 2026, Kalshi expanded its offerings to include commercial aviation outcomes. These new markets allowed bets on flight cancellations at specific airports. An example market asked if 50 percent of scheduled flights at JFK would cancel on October 21, 2026. FlightAware states Kalshi never sought permission for this data use.
Aviation Safety Concerns Raised
FlightAware expresses significant concern over the safety implications of these markets. The lawsuit suggests that allowing wagers on cancellations could incentivise deliberate disruptions. This creates a potential for substantial disorder in air travel. FlightAware claims Kalshi used its logo, name, and data without authorisation.
This continued even after FlightAware issued cease-and-desist letters. Kalshi's markets reportedly stated outcomes were 'verified from FlightAware'. This occurred despite Kalshi's own filings identifying other data sources. FlightAware's terms of service already prohibited such data use. The company later amended its terms to explicitly ban prediction markets. FlightAware believes its business, which relies on aviation safety, faces irreparable harm.
Reputational Damage and Precedent
The lawsuit outlines damage to FlightAware's reputation. Some users reportedly plan to boycott FlightAware products. They mistakenly believe FlightAware partnered with Kalshi on these markets. These risks stem from incentivising speculators to cause cancellations for profit. The legal filing cites a past case involving a soldier. Demands for Injunction and Profits
FlightAware seeks a temporary injunction from the court. This would prevent Kalshi from further using its trademarks or data. The firm also demands Kalshi account for and return all profits. These profits must be attributable to the unauthorised use of FlightAware's marks. Additionally, FlightAware requests up to three times the value of its actual damages.
Legal costs are also part of the requested compensation. Following the lawsuit's filing, Kalshi added a disclaimer to its website. This disclaimer states Flight Cancellation Markets are not endorsed by FlightAware. Kalshi has also removed FlightAware's name from its platform.
